Terms of Service

These Terms of Service (“Terms”) govern your access to and use of AskBrew, an AI customer-support assistant. AskBrew is a product of Xaptis Solutions LLP (“AskBrew”, “we”, “us”). By creating an account or using the service, you (“you”, “customer”) agree to these Terms. If you do not agree, do not use the service.

1. The service

AskBrew lets you train an assistant on your own content, embed a chat widget on your website, and — where you connect an integration — let the assistant look up account information for your signed-in end users (“visitors”). We may add, change, or remove features over time.

2. Accounts & eligibility

  • You must provide accurate account information and keep your credentials secure.
  • You are responsible for all activity under your account, including any team members you invite.
  • You must be able to form a binding contract and use the service in compliance with applicable laws.

3. Acceptable use

You agree not to:

  • Upload content you do not have the right to use, or that is unlawful, harmful, or infringing.
  • Use the service to violate privacy, send spam, or attempt to breach security or rate limits.
  • Reverse engineer, resell, or misuse the service or its APIs beyond what these Terms allow.
  • Use the assistant to provide regulated advice (legal, medical, financial) as if from a licensed professional.

4. Your content & knowledge

You retain ownership of the content, documents, and configuration you add (“Customer Content”). You grant us a limited license to host, process, and use Customer Content solely to operate the service for you — including generating answers and search embeddings. You are responsible for having the rights and permissions to the content you provide.

5. Visitors & data roles

For personal data of your visitors, you are the data controller and AskBrew acts as your processor. You are responsible for providing any notices and obtaining any consents required from your visitors. Our handling of data is described in our Privacy Policy.

6. Fees & billing

  • Paid plans and message/action credits are billed through our payment provider, Paddle, which acts as merchant of record.
  • Subscriptions renew automatically for the billing period you select until cancelled. You can cancel from the dashboard.
  • Fees are exclusive of taxes unless stated; applicable taxes are added at checkout.
  • For recurring payments in India, mandates follow applicable RBI rules, including additional authentication above prescribed thresholds.
  • We offer a full refund on any purchase within 14 days, as set out in our Refund Policy.
  • Credits are consumed as the service is used and do not expire unless stated.

7. Third-party integrations

If you connect a third-party platform (for example Shopify or WooCommerce), your use of that platform is governed by that provider's own terms. You authorize AskBrew to access that platform on your behalf to provide the features you enable, using the minimum access required. You can disconnect an integration at any time from the dashboard.

8. Intellectual property

AskBrew, including its software, design, and trademarks, is owned by Xaptis Solutions LLP and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; no other rights are granted.

9. AI disclaimer

The assistant generates answers automatically and can be incomplete or incorrect. It is a support tool, not a substitute for professional judgment. You are responsible for reviewing its configuration and for any decisions made based on its output. The service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, AskBrew and Xaptis Solutions LLP will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify AskBrew and Xaptis Solutions LLP against claims arising from your Customer Content, your use of the service, or your violation of these Terms or applicable law.

12. Suspension & termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the service in a way that risks harm to others or to the service. On termination, your right to use the service ends; sections that by their nature should survive (such as fees owed, IP, disclaimers, and liability) will survive.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts located in India will have exclusive jurisdiction over disputes arising out of or relating to these Terms, subject to applicable law.

14. Changes to these Terms

We may update these Terms as the service evolves. Material changes will be reflected by the “Last updated” date above; continued use after a change means you accept the updated Terms.
